Donna Leone Hamm

Donna has more than 25 years of experience in the criminal justice and court system. She is a former non-lawyer lower court judge, and has presided over many jury trials during her 10 years on the bench. She formed and operates a non-profit organization, Middle Ground Prison Reform, Inc., which advocates and lobbies for protection of the rights of jail and prison inmates and their families. She provides consulting services to our firm regarding preparation of mitigation for non-capital cases; alternative sentencing reports; executive clemency matters, including applications for commutation of sentence, pardon, parole, absolute discharge, and revocation proceedings. Donna also serves our clients with her expertise in prison policy and procedure, often advocating for medical and mental health care; time computation corrections; resolution of visitation suspensions; and related issues of conditions of confinement. She has been qualified in the state courts as an expert in prison policy and procedure, as well as in executive clemency and parental severance matters. For clients who are preparing for a prison sentence, she provides orientation information to their families. For clients returning home after a prison sentence, she provides expertise in probation or community supervision practices and procedures. James Hamm

James Hamm provides over 32 years of experience with the criminal justice system and he brings a unique experience and perspective to our firm in his work as a consultant / mitigation specialist. James spent almost 18 years in prison. He holds a degree in law and a degree in applied sociology, but is not admitted to the practice of law. He has lobbied at the Arizona legislature for changes in the criminal sentencing code, has lectured nationally and internationally on rehabilitation. He is well versed in prison and jail policies and procedures; civil rights restoration; and other areas of administrative and civil rights law. He has been qualified as an expert in state court as an expert on prison life, prison gangs, and time computation calculations under Arizona's complex and varying criminal codes. He also is an expert witness in capital case sentencing on the issue of rehabilitation. James's work at our firm is primarily focused on state and federal appellate, post conviction relief, and mitigation matters. The Ferragut Law Firm provides representation and advocacy in matters before the Arizona Board of Executive Clemency in cooperation with experts who have extensive experience in parole, commutation, revocation, absolute discharge and pardon hearings. We utilize the services of contract expert witnesses/paralegals; namely, James Hamm and Donna Leone Hamm. James Hamm is a former life-term prisoner who holds degrees in Sociology and Law. Mr. Hamm has been qualified in state and federal courts as an expert witness in several areas, including conditions of confinement, prison gangs and rehabilitation. Mr. Hamm serves our law firm as a non-lawyer consultant/paralegal and specializes in post conviction, habeas corpus and other appellate work. Donna Leone Hamm is a former non-lawyer justice court judge and has been the director of social service agencies serving at-risk youth. She is the founder/director of Middle Ground Prison Reform and has served as the group's exectuive director since 1983. She contracts with this office in matters involving assistance with commutation of sentence applications, parole hearings, revocation hearings and other executive clemency matters. In addition, Mrs. Hamm provides contract assistance with respect to prison and jail policy and procedure. Mrs. Hamm has been qualified in the state courts as an expert witness in death penalty, commutation and prison policy and procedures.
