"Premeditation" means that the defendant acts with either the intention or the knowledge that he will kill another human being, when such intention or knowledge precedes the killing by any length of time to permit reflection. In Arizona there are four types of homicides depending on the facts and circumstances of each case:


1. First Degree Murder

First degree murder involves the intentional killing of another person with premeditation and is punishable from 25 years to life (possibility of parole after 25 years), natural life (no possibility of parole), and the death penalty.


2. Second Degree Murder

Second degree murder involves either intentionally causing the death of another person without premeditation, knowingly causing the death of another, or showing extreme indifference to human life and thereby causing the death of another person. Second Degree Murder has a sentencing range between 10 years to 22 years incarceration.

3. Manslaughter

Manslaughter involves recklessly causing the death of another person or causing the death upon sudden quarrel or heat of passion. The sentencing range for manslaughter is between 7 years to 21 years incarceration.

4. Negligent Homicide

Negligent homicide involves negligent conduct which causes the death of another person. The range of sentence is can be between probation to 10 years incarceration.
